Terms & Conditions – Platform Use Agreement

By creating an account on The Agency Link (“Platform”), you agree to the following Terms & Conditions.
1. Platform Nature & Role
The Agency Link is a B2B networking platform that connects Employers with licensed Recruitment/Manpower Agencies.
The Agency Link:
- Does NOT employ candidates
- Does NOT act as a recruitment agency
- Does NOT guarantee candidate performance
- Does NOT participate in negotiations or contractual agreements
- Is NOT a party to any agreement entered between Employers and Agencies
The Platform acts solely as an intermediary digital marketplace.
2. No Liability Clause
The Agency Link shall not be liable for:
- Any disputes between Employers and Agencies
- Candidate performance, misconduct, or qualifications
- Financial losses arising from recruitment agreements
- Non-payment or delayed payment between parties
- Breach of contract by either part
- Legal or regulatory violations committed by either party
All business transactions are conducted at the sole risk and discretion of the parties involved.
3. Independent Due Diligence
Both Employers and Agencies agree that:
- They are solely responsible for conducting independent verification and due diligence before entering into any agreement.
- They must verify licenses, registrations, and legal compliance independently.
- The Platform does not verify or guarantee the authenticity of documents submitted by users.
4. Account Responsibility
Users agree that:
- All information provided must be accurate and truthful.
- They are responsible for safeguarding login credentials.
Any misuse of the platform may result in suspension or permanent removal.
5. Limitation of Liability
To the maximum extent permitted by law:
The Agency Link’s total liability, if any, shall not exceed the total platform fees paid by the user within the previous three (3) months.
The Platform shall not be liable for:
- Indirect damages
- Loss of profit
- Business interruption
- Reputational damage
- Consequential or incidental losses
6. Indemnification
Users agree to indemnify and hold harmless The Agency Link, its owners, directors, and affiliates against any claims, losses, legal actions, or damages arising from:
- Their business dealings
- Violations of law
- Breach of agreements
- Misrepresentation
7. Compliance with Laws
Both Employers and Agencies must comply with:
- Applicable labor laws
- Immigration laws
- Commercial licensing regulations
- Anti-trafficking regulations
- Any applicable GCC or international laws
The Platform does not assume responsibility for regulatory compliance of users.
8. Termination of Account
The Agency Link reserves the right to:
- Suspend accounts
- Remove listings
- Terminate access
- Refuse service
Without prior notice if misuse or suspicious activity is detected.
9. Dispute Resolution
Any disputes between Employers and Agencies must be resolved directly between the parties.
The Agency Link shall not mediate, arbitrate, or participate in disputes.
10. Governing Law
These Terms shall be governed by the laws of State of Kuwait.
Additional Specific Clause – For Agencies
Agencies additionally confirm:
- They hold valid recruitment/manpower licenses.
- They are legally authorized to supply workers.
- They will not engage in illegal recruitment practices.
- They will comply with anti-trafficking and ethical recruitment standards.
Additional Specific Clause – For Employers
Employers additionally confirm:
- They will not bypass agency agreements illegally.
- They will comply with labor law obligations.
- They will not request illegal recruitment practices.
- They assume full responsibility for employment contracts signed.
